Ghislaine Maxwell tried to persuade the U.S. Supreme Court to overturn her conviction by arguing that Jeffrey Epstein’s 2007 non-prosecution agreement in Florida should also have protected her from being prosecuted years later in New York. Her lawyers contended that the agreement’s promise not to prosecute Epstein’s “potential co-conspirators” bound the federal government beyond South Florida and barred the Southern District of New York from bringing the case that ultimately led to Maxwell’s 2021 conviction. Lower courts rejected that argument, holding that the agreement did not prevent New York prosecutors from charging her, and Maxwell then asked the Supreme Court to take the case.

The Supreme Court declined to hear her appeal, leaving both her conviction and 20-year prison sentence intact. The refusal was a major setback because it effectively ended Maxwell’s effort to use Epstein’s controversial sweetheart deal as a vehicle for undoing her own prosecution. The justices did not issue a substantive ruling explaining their reasoning, which is normal when certiorari is denied, but the practical result was clear: the lower-court decisions remained in place, and Maxwell received no relief from the country’s highest court. Her remaining options became far narrower, centered on other forms of post-conviction litigation rather than a direct Supreme Court challenge to the NPA issue.
