The defense argued that the affidavit supporting the January 9, 2023, search warrant omitted material information and included details derived from what they claimed were unconstitutional investigative methods, specifically the use of Investigative Genetic Genealogy (IGG). They contended that the warrant lacked particularity, effectively functioning as a general warrant, and that the affidavit was not properly incorporated into the warrant, potentially leading to an overbroad search of Kohberger's digital data.
