Important sources include creation of a risk, a voluntary undertaking, special relationships, responsibilities concerning third persons, land possession, and statutes. Negligence per se requires a relevant enactment, a protected plaintiff, a protected type of harm, a violation, the governing effect of that violation, and consideration of excuse. The remaining negligence elements still require proof.Foreseeability can inform duty, breach, and proximate cause, but it performs different work in each place. A careful answer identifies that work instead of using foreseeability as a single conclusion.
