Cops’ Son Arrested for DWI After Car Crash in Red Bank, NJ
On June 3, 2024 around 12:32 PM, Patrolwoman Grace Maggiulli with the Red Bank Police Department responded to the scene of a motor vehicle accident involving a white 2023 Chevrolet and a black BMW X3 on Maple Avenue near the intersection with E Bergen Boulevard. She first made contact with the driver of the BMW, who told her that he was struck by the driver of the Chevrolet. After getting his information, she made contact with the driver of the Chevrolet, and he was identified as 24-year-old Gustavo.
Gustavo was in denial about what happened, and he was unable to provide all his documents. He also indicated to the officer that both his parents were law enforcement officials in the New York. As she was speaking with Gustavo, she observed indicators of impairment and asked for another officer to come on scene for backup. Gustavo was asked to exit the vehicle so that Patrolwoman Maggiulli could administer field sobriety exercises, but he hesitated after she attempted to administer the Horizontal Gaze Nystagmus (HGN) test. He denied consuming alcohol or taking any prescription medications, but he would later contradict himself by telling the officers that he had been prescribed a medication.
Based on his hesitation to perform field sobriety exercises, her Sergeant came on scene. Gustavo eventually agreed to perform field sobriety exercises after changing his shoes. The field sobriety exercises included the Horizontal Gaze Nystagmus (HGN) test, Walk and Turn test, and One Leg Stand test. He was unable to follow instructions during these tests.
Based on the motor vehicle crash, the indicators of impairment, and his inability to adequately perform the field sobriety exercises, Gustavo was placed under arrest for driving under the influence. After he was placed under arrest, a search of his vehicle incident to arrest revealed the presence of needles and other prohibited items. Patrolwoman Maggiulli transported Gustavo to the Red Bank Police Department for further processing. He was issued the following traffic tickets: Operating under the influence, reckless driving, careless driving, following too closely, failure to possess driver license, and operation of motor vehicle while in possession
Gustavo was also charged with 2 counts of possession of CDS under 2C:35-10A(1), use or possession with intent to use (2C:36-2A) and possession of hypodermic syringe for use with CDS (2C:36-6A). His case was transferred to the Prosecutor’s office.
