The European Union has a big problem—a potentially fatal one. How should it deal with a member state or states that reject democracy and the rule of law? So far, not even Viktor Orbán’s Hungary has turned full-blown authoritarian. However, his 14 unbroken years of “illiberal democracy”, his constitution rewriting, creeping media control, challenges to judicial independence, and calls for popular resistance against the EU are becoming less easy to ignore or accommodate. Yet, the EU’s tools to address democratic backsliding are blunt and its institutions are reluctant to use them. Above all, while a member state can leave the union, the union itself has no power to expel a club member that breaks its core democratic rules. In Protecting Democracy in Europe: Pluralism, Autocracy and the Future of the EU (Hurst, 2024), Tom Theuns looks back at the history of this design fault and how to put it right. Saadia Yacoob’s excellent new book, Beyond the Binary: Gender and Legal Personhood in Islamic Law (U of California Press 2024), makes a compelling argument about gender and Islamic law that has been shockingly overlooked: Legal personhood in Islamic law is intersectional and relational, and gender is not a binary. While Muslims commonly treat gender as a fixed, stand-alone category in Islam that fundamentally shapes an individual’s legal status, Yacoob shows that that legal status in Islamic law was not determined by fixed categories of male or female but by a complex web of social hierarchies, including class, age, freedom, enslavement, social status, and lineage. She challenges the conventional binary understanding of gender by drawing on a rich array of historical, early Hanafi texts from the ninth to twelfth centuries. With insightful coverage of topics such as marriage, slavery, and sexual ethics, Yacoob finds that the categories of man and woman are unstable and conditional in Islamic law. In fact, she shows, the person’s legal and social status determined their role in society and not just their role but also how they were punished and treated in the law. Further, she argues that the category gender “did not exist as a group that had shared interests or a shared social position that led to a shared legal personhood as men or women” (p. 92). In our interview today, Yacoob describes the origins of the book and its main arguments and findings and explains what she means by “beyond the binary” and “legal personhood” in the title of the book. We also discuss the specific chapters and some of the major themes that show up in each chapter, such as illicit sex and its consequences depending on one’s legal personhood, how a “child” was understood in her sources, what the terms “emphasized femininity” and “hegemonic masculinity” mean. Yacoob also explains what scholars miss by using only “gender” as an analytical category for studying power relations in Islamic law. We end with some of the practical implications of the arguments and findings of this book for both academics and lay Muslims, such as how we can use Islamic law itself to build our critiques of where we are today. Millions of GIs returned from overseas in 1945. A generation of men who had left their families and had learned to kill and to quickly dispatch sexual urges were rapidly reintegrated into civilian life, told to put the war behind them with cheer and confidence. Many veterans struggled, openly or privately, with this transition. Others in society wondered what the war had wrought in them. As Erin Lee Mock shows in this insightful book, the “explosive” potential of men became a central concern of postwar American culture. This wariness of veterans settled into a generalised anxiety over men’s “inherent” violence and hypersexuality, which increasingly came to define masculinity. Changed Men: Veterans in American Popular Culture after World War II (University of Virginia Press, 2024) by Dr. Erin Lee Mock engages with studies of film, media, literature, and gender and sexuality to advance a new perspective on the artistic and cultural output of and about the “Greatest Generation,” arguing that depictions of men’s violent and erotic potential emerged differently in different forms and genres but nonetheless permeated American culture in these years. Viewing this homecoming through the lenses of war and trauma, classical Hollywood, pulp fiction, periodical culture, and early television, Dr. Mock shows this history in a provocative new light. In this episode of High Theory, Faye Raquel Gleisser tells us about Risk. A calculable danger in economics, athletics, sociology, or healthcare, risk has become a socially constructed danger that changes who we are and how we move through the world. Faye asks us to think about how risk management and risk literacy shaped the conceptual and performance work of American artists in the late twentieth century. Who is at risk? Who is safe? And how do we know? Faye’s book, Risk Work: Making Art and Guerrilla Tactics in Punitive America, 1967–1987 (U Chicago Press, 2023) studies how artists in the US starting in the 1960s came to use guerrilla tactics in performance and conceptual art, maneuvering policing, racism, and surveillance. As US news covered anticolonialist resistance abroad and urban rebellions at home, and as politicians mobilized the perceived threat of “guerrilla warfare” to justify increased police presence nationwide, artists across the country began adopting guerrilla tactics in performance and conceptual art. Risk Work tells the story of how artists’ experimentation with physical and psychological interference from the late 1960s through the late 1980s reveals the complex and enduring relationship between contemporary art, state power, and policing. Drawing on art history and sociology as well as performance, prison, and Black studies, Gleisser argues that artists’ anticipation of state-sanctioned violence invokes the concept of “punitive literacy,” a collectively formed understanding of how to protect oneself and others in a carceral society. Faye Raquel Gleisser is an associate professor of art history at Indiana University and curator, whose work focuses on three main subject areas: art and tactical intervention; the racial logics of archives; and curatorial ethics and canon formation. By bridging curation, art history, and performance studies, she investigates histories of art that challenge intertwined anti-Black societal structures and patriarchal, white-centering notions of value that have long limited the canon of “American art.” She approaches art as a material manifestation of sociopolitical conditions and artists as theorists of power and social encounter. In Becoming Belle da Costa Greene: A Visionary Librarian through Her Letters (Harvard University Press, October 2024), Deborah Parker chronicles the making and empowerment of a female connoisseur, curator, and library director in a world where such positions were held by men. Belle da Costa Greene (1879–1950) was Pierpont Morgan’s personal librarian (1908–1913) and the first Director of the Morgan Library (1924–1948). She was also the daughter of two mixed-race parents and passed for white. In the nearly six hundred letters that Greene sent to art historian Bernard Berenson (1865–1959), Parker identifies Greene’s energetic pursuit of exceptional opportunities, illuminating the artistry and imaginative features of Greene’s writing—her self-invention, her vibrant responses to books and art, and her pathbreaking work as a librarian. As Greene transformed a private library into a magnificent public institution, she also transformed herself: hers was a life both lived and writ large. Deborah Parker is Professor of Italian at the University of Virginia, and her books include Commentary and Ideology: Dante in the Renaissance, Bronzino: Renaissance Painter as Poet, and Michelangelo and the Art of Letter Writing. In Soldier's Paradise: Militarism in Africa After Empire (Duke UP, 2024), Samuel Fury Childs Daly tells the story of how Africa’s military dictators tried and failed to transform their societies into martial utopias. Across the continent, independence was followed by a wave of military coups and revolutions. The soldiers who led them had a vision. In Nigeria and other former British colonies, officers governed like they fought battles—to them, politics was war by other means. Civilians were subjected to military-style discipline, which was indistinguishable from tyranny. Soldiers promised law and order, and they saw judges as allies in their mission to make society more like an army. But law was not the disciplinary tool soldiers thought it was. Using legal records, archival documents, and memoirs, Daly shows how law both enabled militarism and worked against it. For Daly, the law is a place to see decolonization’s tensions and ironies—independence did not always mean liberty, and freedom had a militaristic streak. In a moment when militarism is again on the rise in Africa, Daly describes not just where it came from but why it lasted so long. How do states build vital institutions for market development? Too often, governments confront technical or political barriers to providing the rule of law, contract enforcement, and loan access. In From Click to Boom: The Political Economy of E-Commerce in China (Princeton, 2024) Lizhi Liu suggests a digital solution: governments strategically outsourcing tasks of institutional development and enforcement to digital platforms—a process she calls “institutional outsourcing.” China’s e-commerce boom showcases this digital path to development. In merely two decades, China built from scratch a two-trillion-dollar e-commerce market, with 800 million users, seventy million jobs, and nearly fifty percent of global online retail sales. Contrary to conventional wisdom, Liu argues, this market boom occurred because of weak government institutions, not despite them. Gaps in government institutions compelled e-commerce platforms to build powerful private institutions for contract enforcement, fraud detection, and dispute resolution. For a surprisingly long period, the authoritarian government acquiesced, endorsed, and even partnered with this private institutional building despite its disruptive nature. Drawing on a plethora of interviews, original surveys, proprietary data, and a field experiment, Liu shows that the resulting e-commerce boom had far-reaching effects on China. Institutional outsourcing nonetheless harbors its own challenges. With inadequate regulation, platforms may abuse market power, while excessive regulation stifles institutional innovation. China’s regulatory oscillations toward platforms—from laissez-faire to crackdown and back to support—underscore the struggle to strike the right balance. Lizhi Liu is assistant professor at the McDonough School of Business at Georgetown University, where she is also a faculty affiliate of the Department of Government. Her work has been published by American Economic Review: Insights, Studies in Comparative International Development, Minnesota Law Review, Oxford University Press, and Princeton University Press.
