What is a textualist, and why does that judicial philosophy dominate the current U.S. Supreme Court? Join us for a special online event as recently retired Supreme Court Justice Stephen Breyer gives us his provocative analysis that deconstructs the textualist philosophy of the current Supreme Court’s supermajority and makes his case for a better way to interpret the Constitution. Textualists claim that the right way to interpret the Constitution and statutes is to read the text carefully and examine the language as it was understood at the time the documents were written. This, however, is not Justice Breyer’s philosophy, nor has it been the traditional way to interpret the Constitution since the time of Chief Justice John Marshall. Justice Breyer recalls Marshall’s exhortation that the Constitution must be a workable set of principles to be interpreted by subsequent generations. Most important in interpreting law, says Breyer, is to understand the purposes of statutes as well as the consequences of deciding a case one way or another. He illustrates these principles by examining some of the most important cases in the nation’s history, among them the Dobbs and Bruen decisions from 2022 that he argues were wrongly decided and have led to harmful results for our country. Scientists have known for decades that climate change is an existential crisis. For just as long, critics say there has been a complete failure of our institutions to rise to the challenge. Governments have struggled to meet even modest goals. Fossil fuel interests maintain a stranglehold on political and economic power. Even though we have seen growing concern from everyday people, civil society has succeeded only in pressuring decisionmakers to adopt watered-down policies. All the while, the climate crisis worsens. Is there any hope of achieving the necessary systemic change? Dana R. Fisher argues that there is a realistic path forward for climate action―but only through mass mobilization that responds to the growing severity and frequency of disastrous events. Spurred by the lack of progress, climate activism has become increasingly confrontational. Fisher examines the radical flank of the climate movement: its emergence and growth, its use of direct action, and how it might evolve as the climate crisis worsens. She considers when and how activism is most successful, identifying the importance of creating community, capitalizing on shocking moments, and cultivating resilience. Discussion of the climate crisis has always suffered from a problem of abstraction. Data points and warnings of an overheated future struggle to break through the noise of everyday life.
