Woman Arrested for DWI After Hit-and-Run Crash at Almost 4 TIMES LEGAL LIMIT
On February 9, 2023 around 5:39 PM, Sergeant Christopher Chicoris and Officers Matthew Rizzo and Paul Ryan with the Boonton Township Police Department were dispatched to the area of McCaffrey Lane in reference to a hit-and-run. Officer Ryan made contact with the caller, who advised him that his vehicle was struck by a black Volvo SUV on the 300 block in the Town of Boonton. Officer Rizzo located the suspected Volvo in the Tourne County Park. Upon locating the vehicle, Officer Rizzo made contact with the driver, who was identified as Kira.
Kira told Officer Rizzo that she thought she hit something and that the other vehicle was following her. He noticed damage to the passenger side of her vehicle and detected the odor of alcohol as he was speaking with Kira. Officer Ryan arrived to assist after he was finished speaking with the caller. Since the incident occurred in the Town of Boonton, their agency was notified and Sergeant Mondino arrived on scene as well to be briefed on the situation.
Based on their indicators of impairment, Sergeant Chicoris instructed Officer Ryan to ask Kira to exit the vehicle and perform field sobriety exercises. Officer Ryan started with the Horizontal Gaze Nystagmus (HGN) test. This was followed by the One Leg Stand and Walk and Turn tests. Kira did not seem to understand the instructions, so Sergeant Chicoris also had Kira perform the Walk and Turn and One Leg Stand test. Kira was unable to complete these tests satisfactorily.
Based on the motor vehicle accident, the odor of alcohol, and the indicators of impairment, Kira was placed under arrest for operating under the influence. Her vehicle was impounded by Corigliano Towing for a mandatory 12-hour hold under John’s Law. Officer Rizzo placed her in handcuffs, advised her of her Miranda rights, and transported her to the Boonton Township Police Department for further processing.
At the Boonton Township Police Department, Kira was searched by Officer Nicole Montemorano from the Town of Boonton Police Department. She agreed to submit breath samples for testing and her Alcotest results indicated a BAC level of 0.31%, which was nearly 4 times the legal limit of 0.08%. Once they finished processing her, Kira was released to her husband pending her court appearance after he signed the Potential Liability Warning form on her behalf. Officer Rizzo issued her summonses for operating under the influence, reckless driving, and careless driving. The Town of Boonton also issued her summonses for careless driving, failure to report accident, and leaving the scene of an accident involving property damage
Court records indicate on May 16, 2023, Kira was found guilty of operating under the influence. As a result of being found guilty, Kira’s license was revoked for 4 months, she had to use an ignition interlock device for 9 months, and she had to spend 12 hours at an intoxicated driver resource center. She also had to pay a total of $890 in fines. The other citations were dismissed as part of a plea agreement. On November 30, 2023, Kira was arrested again for DWI in Chester Township, New Jersey after crashing into a bridge at almost 5 times the legal limit (0.373% BAC). Her case from Chester Township was disposed of in court on September 19, 2024.
